Your rights under the Fair Debt Collection Practices Act

The Fair Debt Collection Practices Act protects debtors from harassment by debt collectors. The law makes it illegal to harass, abuse, or mislead you and limits the ability of debt collectors to contact you at certain times or places. In addition, it gives you as a debtor the right to sue the violating debt collector for damages or for an injunction to stop the harassing activity. The act applies only to debt collectors, not to creditors collecting their own debts, and it does not apply to commercial or business debts. What type of collection behavior is prohibited under the act?

The following types of behavior are prohibited under the Fair Debt Collection Practices Act:

  • Contacting a debtor at work without consent

  • Threatening to place you in jail or take you to court
  • Providing false information
  • Collectors failing to identify themselves on the phone
